1. Acceptance of Terms
By accessing or using Maintenance Minder ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to all the terms, you may not use the Service.
2. Description of Service
Maintenance Minder is a web-based fleet maintenance tracking application designed for truck owner-operators and small fleets. The Service allows users to track vehicles, schedule maintenance, view spending analytics, generate reports, and manage service history.
3. Account Registration
To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.
4. Subscription Plans and Billing
The Service offers multiple subscription tiers: Free (1 vehicle, 1 task), 1 Vehicle ($9.99/month), 5 Vehicles ($39.99/month), 10 Vehicles ($74.99/month), 20 Vehicles ($149.99/month), and fleet pricing for 21+ vehicles.
Paid plans include a 30-day free trial beginning on the date of registration. After the trial period ends, your payment method will be charged on a recurring monthly basis unless you cancel prior to the end of the trial. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months of service.
5. User Responsibilities
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You are solely responsible for the data you enter into the Service, including vehicle information, maintenance records, and financial data. You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious code, viruses, or harmful content
- Resell, redistribute, or sublicense the Service without permission
6. Intellectual Property
The Service, including its code, design, logos, and branding, is the exclusive property of Maintenance Minder. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of all data you enter into the Service.
7. Service Availability
We strive to provide reliable and uninterrupted access to the Service but do not guarantee 100% uptime. The Service may be unavailable during maintenance windows, updates, or due to circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.
8. Limitation of Liability
To the maximum extent permitted by law, Maintenance Minder and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. The Service is provided "as is" without warranties of any kind, either express or implied.
Maintenance Minder provides maintenance tracking and scheduling tools; it does not guarantee that using the Service will prevent equipment failure, accidents, or regulatory non-compliance. Users bear full responsibility for the maintenance and safe operation of their vehicles.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.
10. Termination
We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your right to access the Service ceases immediately. We will make reasonable efforts to provide you an opportunity to export your data before account termination.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
